Fair Debt Collection Practices Act Violations by NationStar | Francis M. King, Esq.

NationStar is a lender and loan serviced for banks including Bank of America. In communications sent as recently as July 24, 2012, NationStar has included Fair Debt Collection Practices Act (FDCPA) Notices that violate the requirements of the FDCPA by “overshadowing” the right of borrowers to dispute the validity of the debt. Borrowers who have been provided this faulty notice by NationStar may be entitled to damages under the FDCPA. A claim can be made through an independent lawsuit or as a counter claim or defense in a foreclosure action by the bank.

It is important that you keep all correspondence from your lender or servicer so these violations can be identified and claims made on your behalf.
